According to the Personal Data Protection Law No. 6698 ("KVKK"), Arvi Karavan San A.Ş. ("ARVİ") has an obligation to inform (KVKK Article 10) and within this scope, this text aims to inform you about the processing of your Personal Data and your rights as a data owner.

It is aimed to inform you about the personal data processing processes. 

As ARVİ; We use cookies etc. methods on the Site in order to conduct statistical studies on Site usage, conduct targeted advertisements/promotion and ensure that you have an effective investor, visitor and business partner experience.   1. Processing of Personal Data

Your personal data is processed by ARVI as the Data Controller in order to be used within the scope of all kinds of services to be provided to customers, to determine the addressee of all kinds of work and transactions to be carried out and to record identity, address, tax number, other personal and financial information to determine the information of customers in order to carry out all kinds of information and evaluation regarding the mentioned activities in the shortest time and in the most accurate way, to organize information and documents that will form the basis of the work and transactions to be carried out on paper or in electronic environment, to comply with the information storage, reporting and information obligations stipulated by all competent authorities of judicial and administrative nature, especially the institutions and organizations related to commercial activities and the courts, to be able to provide all kinds of services requested by customers in the highest quality and to fulfill the obligations imposed by the contracts concluded with customers, to determine the investment needs of customers, to renew contracts when necessary and to provide faster service to customers within the scope of new contract needs.

  1. What are our purposes for processing your personal data and what personal data do we process? 

If you visit our center;

  • In order to ensure the security of you, ARVI and its employees and other third parties against any act, crime or behavior that is likely to occur in our company center against the legislation and to fulfill our obligations to provide information, documents and other related obligations to official/judicial institutions and organizations, we process your company center entrance-exit visit information and documents and security camera records,
  • In order to provide you with a more advanced service, we process your name, surname, telephone number, e-mail, T.R. identity number, identity information and address data.

 

If you visit our website;

  • In order to conduct statistical studies on your usage, conduct targeted advertisements/promotion and ensure that you have an effective customer/investor experience when you visit our site, we use methods such as cookies on the Site and process your Site/Mobile Application usage (navigation) information.   • In order to communicate with you, your name, surname, e-mail address, and your log records information for the purpose of ensuring transaction security, 
  • In line with our preferences on our site, offering you special opportunities and offers, creating general or personalized campaigns, advantages, promotions, advertisements, organizing campaigns and other events, segmentation, profiling, reporting, marketing and analysis studies, performing advertisements and marketing/communication activities (notifications on the Site, pop-up displays, personalized offers, customization of user screens, surveys, etc.) belonging to ARVI on the Site or other 3rd party environments, studies aimed at improving the investor and visitor experience and strategic planning, analysis and business development studies regarding operational processes, name, surname, gender, e-mail address, mobile phone number, optionally if you share, date of birth, province, district, demographic information, approaches to notifications/surveys/offers/campaigns on the Site, habits, behaviors, preferences, search movements, segments, cookie records, cookies and advertising We process your identifier/identity information and device ID, communication preferences, survey responses.

If you contact us through our Communication Channels;

  • If you contact us via call center, e-mail, Site, social media and similar channels (“Our Communication Channels”), we process your name and surname, social media username, e-mail address, mobile phone number, landline number if shared, legal transaction information if relevant, your requests and complaints, log records data, other relevant information to be provided by you regarding your requests and complaints, 
  • Your call center voice recordings to be used as evidence in our efforts for visitor and investor satisfaction and disputes that may arise between us, 
  • If your request and complaint is related to our Center, we process your Center security camera recordings.

Legal Processes and Internal Activities

  • To ensure the safety of you, ARVI and its employees and other third parties against any possible act, crime or behavior contrary to the legislation, to fulfill our obligations arising from the legislation and to fulfill our legal obligations towards authorized and authorized private or public institutions and organizations, to exercise all kinds of rights of lawsuit, response and objection against official institutions and organizations such as courts, enforcement offices and arbitration boards in disputes that may arise, to conduct negotiation and agreement processes regarding disputes, to ensure that the necessary information is delivered to you in case you request information from us or apply within the scope of your legal rights, to prevent use contrary to the contract and legislation, to detect suspicious transactions and illegal uses, to carry out cancellation transactions, to carry out internal audit and control, reporting, testing, development studies and studies and developments aimed at improving the investor and visitor experience, strategic planning, analysis and business development studies regarding operational processes, name and surname, gender, date of birth if you share optionally, signature and T.R. ID number if transferred due to legal processes or included in documents sent by official authorities. We process your ID Number, mobile phone number, e-mail address, address, requests and complaints, invoices, payment information (first 6 and last 4 digits of the credit/debit card, payment amount, bank information that the card belongs to, reference number), call center voice recordings, commercial communication permission information, log records, IP address, cookie records (IP address, navigation information, device information (ID) used and traffic data) in case you make a transaction through the Site, Center security camera records, relevant legal transaction information and correspondence and file information regarding dispute processes in case you make a transaction at our Center. 
  1. What is Our Method and Legal Reason for Collecting Your Personal Data?

We collect your personal data by our Center, business partners or consultants; through security cameras and devices located in our Center, recording the information you verbally declare to ARVI employees in our Center, recording the information you provide during your visit to our Site in our systems and performing transactions through these channels, recording all kinds of collections, deliveries, transactions, survey filling, registration, behavioral movements and transactions in our Center and Site, recording your requests and complaints that you convey to us during mutual communication through our Communication Channels or our Center, recording your conversations with the call center, and non-automatic methods such as recording information/documents related to you received from official institutions, organizations and judicial/administrative authorities.

Your personal data;  

  • “The necessity of processing personal data of the parties to the contract, provided that it is directly related to the establishment or execution of a contract” regarding the fulfillment of our obligations and post-contract support processes,
  • “Explicit consent” you will provide regarding personal data processing processes and commercial communication activities within the scope of marketing, segmentation and analysis studies within the scope of the site, 
  • “Data processing is mandatory for the legitimate interests of the data controller” regarding the detection and prevention of suspicious transactions regarding the use of the site, ensuring transaction security, studies regarding operational processes (strategic planning, analysis and business development studies) and our investor and visitor relations processes,
  • “Data processing is mandatory for the legitimate interests of the data controller” regarding the recording processes with security cameras in our center, “Data processing and transfer is mandatory for the establishment, exercise or protection of rights” and “fulfillment of legal obligation”,
  • “fulfillment of legal obligation” and “explicitly provided for in the laws” regarding our obligations arising from the legislation,
  • Legal disputes, investigations and other judicial/official We collect/process based on the legal grounds that “data processing and transfer are mandatory for the establishment, exercise or protection of rights”, 
  • It has been made public by the relevant person. 

You can stop personal data processing processes based on explicit consent at any time and without giving any reason, by applying to us in writing. 

  1. To Whom and For What Purpose Do We Transfer Your Personal Data?

The confidentiality of visitors' and investors' personal data is essential for ARVI. As ARVI, we only transfer your personal data to third parties in accordance with the purposes specified in this Text and in accordance with Articles 8 and 9 of the KVKK. In this context;

  • To deliver papers, documents and all kinds of movable goods that need to be physically delivered to you, to provide logistics services and post-contract support services, to resolve your requests and complaints and to contact you when necessary, to provide information technologies, marketing/advertising/analysis activities or consultancy that requires expertise, etc. We transfer your personal data to business partners, suppliers and service providers located in Turkey and abroad for the purpose of receiving their services (electronic messaging service providers, call centers, those collecting personal data through devices, marketing/advertisement/analysis service providers, database and server service providers, infrastructure maintenance and support service providers, legal and financial consultancy service providers, e-invoice/e-archive invoice service providers, independent audit service providers, shipment/cargo/courier, archiving and storage service providers, etc.), provided that it is used by these companies within the scope of the services provided for the purpose of fulfilling ARVI's activities.
  • In case you receive information from ARVI's website, we transfer the information regarding your transaction to the relevant website operators in order to fulfill our contractual obligations to the relevant website operators. 
  • In order to fulfill our obligations to provide information, documents and other related obligations to authorized and authorized private or public institutions and organizations, judicial authorities and official institutions/organizations and to exercise our legal rights such as lawsuit and response rights, we transfer the information requested from us to these institutions, organizations and authorities.
  • Personal data falling within the scope of KVKK can be shared with persons or organizations permitted by the provisions of legal legislation, other public legal entities and regulatory authorities, authorized judicial authorities), program partner organizations operating in Turkey and/or abroad from which ARVI receives services and cooperates in order to carry out investment services and activities and ancillary services, and other third parties.
  • In order to follow up and detect suspicious transactions and prevent illegal transactions, we transfer them to our suppliers from whom we receive consultancy services and payment institutions related to the relevant transaction when necessary.
  • We transfer them to our suppliers within the scope of activities related to increasing the visit traffic on our site.
  • If you make a payment to ARVI by credit/debit card for any reason, we transfer your credit/debit card information to third parties that provide the service, such as the relevant bank, electronic payment institution, etc., without being recorded by ARVI.
  • We transfer it to dealers with whom we use a common customer management and cash register system for the purpose of conducting business processes.
  1. What are your rights under the KVKK?

You can always submit your requests regarding your personal data processed by ARVI within the scope of Article 11 of the KVKK in writing in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller or by using your registered electronic mail (KEP) address, secure electronic signature, mobile signature or your electronic mail address that you have previously notified to ARVI and is registered in our system to the addresses below. 

ARVI Visitors, Customers and Business Partners within the scope of Article 11 of the KVKK;

  1. To learn whether personal data has been processed,
  2. To request information if personal data has been processed,
  3. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  4. To know the third parties to whom personal data is transferred domestically or abroad,
  5. To request correction of personal data if they are processed incompletely or incorrectly,
  6. To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
  7. To request that the transactions made pursuant to subparagraphs (e) and (f) be notified to third parties to whom personal data is transferred,
  8. To object to the emergence of a result against the person by exclusively analyzing the processed data through automated systems, i. To request compensation for the damages incurred due to the unlawful processing of personal data.
